Baru Bian: Time now to stop injustice

Transforming Sarawak is my vision said the Ba’Kelalan state assemblyperson, Baru Bian, in an interview with CJMY recently.

He also said that other pressing issues in Sarawak are the NCR (Native Communal Rights) land issue and the unfulfilled 18-point agreement by the federal government.

“It is worsening today as the state government is taking away native lands without any compensation and leasing to companies in Sarawak or outside Sarawak. Notwithstanding the decisions by the High Court in 2001, this has given wider and clear definition of NCR, the state government still refused and denying the natives of their ancestral lands,” said Baru.

Under the 18-point agreement with the Federation of Malaya in 1963, 3 main points still unfulfilled. The first one is the 10% of the civil service in Sarawak must be headed by a local Sarawakian; two, the number of seats for Sarawak in the parliamentary constituency is still not allocated fairly especially after Singapore withdrew from the Federation of Malaya.

The last and major point, which is still outstanding, is the number of scholarships allocated to Sarawakian which is still not accorded equitably. Neither is the fair number of Sarawakians sent as ambassadors overseas.

It is very disheartening that although Sarawak is part of Malaysia, it is lagging very far behind in terms of development. This is due to corruption by leaders in the state or mismanagement.

“Since my high school days I had the ambition to be a lawyer. There is a need for professional lawyers to help the natives on their land rights. Since 1990 till today, I had been handling 200 cases relating to native land rights. I won some cases. I wanted a quicker way to resolve the NCR issue for the natives,” said Baru when asked why he joined politics.

He was convinced that a case filed through judiciary system could take up to ten years which is too long. He believed that with political powers, he could make or change policies to resolve issues such as NCR.

Even a case is won after ten years, the stolen land by the state government from the natives through bribery and leased to corporations for oil palm for example would have harvested and made tons of money. The land would have been exploited by then.

According to Baru, he hopes to bring in good governance and transparency as well as justice for all Sarawakians which they had denied for so long.

“They deserve a flourishing economy and prosperity in a state with plentiful of natural resources and human capital,” he said.

Tuntutan Segera Perhimpunan BERSIH 3.0

1. Bersihkan senarai undi
- Senarai undi harus dibersihkan dengan segera untuk menyingkirkan ‘pengundi hantu’ seperti orang yang telah meninggal.
- Pendaftaran pengundi automatik yang diselarikan dengan senarai Jabatan Pendaftaran Negara boleh menyelesaikan masalah pengundi hantu dalam jangka masa panjang.

2. Mereformasikan undi pos
- SEMUA pengundi seharusnya dibenarkan untuk mengundi melalui undi pos atau mengundi lebih awal sekiranya seseorang individu itu tidak dapat berada di kawasan pengundian semasa hari mengundi.
- Anggota polis dan tentera yang tidak bertugas harus mengundi seperti biasa pada hari mengundi.
- Undi pos mesti dijalankan dengan telus! Agen parti politik harus dibenarkan untuk memantau proses undi pos.

3. Gunakan dakwat kekal
- Penggunaan dakwat kekal boleh mengelakkan seseorang (atau pengundi hantu) daripada mengundi beberapa kali.

4. Masa kempen minima 21 hari
- Masa yang lebih panjang diperlukan untuk calon menyebarkan maklumat, terutamanya di kawasan luar bandar dan pedalaman. Contohnya, pilihanraya negeri Sarawak baru-baru ini diberi masa kempen 10 hari sahaja.
- Pada 1955, ketika era pemerintahan penjajah, pilihanraya mempunyai masa kempen sepanjang 42 hari. Manakala semasa Pilihanraya Umum ke-12 pada 2008, masa kempen 8 hari sahaja.

5. Akses media yang bebas dan adil
- RTM dan Bernama adalah agensi media yang dibiayai oleh kerajaan. Mereka sepatutnya memberi liputan yang seimbang dan adil untuk semua parti yang bertanding.
- Parti politik harus dibenarkan untuk membuat pengiklanan tanpa sebarang diskriminasi dan penapisan.
- Ini adalah mengenai keadilan! Semua media perlu memberikan hak untuk semua parti membalas kepada tuduhan-tuduhan negatif terhadap mereka.

6. Kukuhkan institusi awam
Institusi awam dan kakitangan kerajaan harus tidak berat sebelah dan menegakkan undang-undang dan demokrasi. Institusi awam harus direformasikan supaya bertindak secara bebas, menegakkan undang-undang dan melindungi hak asasi manusia.
Contohnya :
- Suruhanjaya Pilihanraya (SPR) hendaklah memastikan pilihanraya yang bebas dan adil.
- Badan Kehakiman harus memelihara kebebasannya dan menegakkan kedaulatan undang-undang tanpa gentar atau memihak.
- Peguam Negara perlu bertindak secara tidak berat sebelah dan mengutamakan kepentingan rakyat.
- Suruhanjaya Pencegahan Rasuah Malaysia harus bertindak dengan adil dan menghentikan pendakwaan selektif dan penyalahgunaan kuasa.
- Polis Di Raja Malaysia perlu bertindak secara profesional dalam melaksanakan tugas dan menegakkan kedaulatan undang-undang.

7. Hentikan rasuah
- Rasuah adalah kegiatan mencuri dari rakyat untuk kepentingan peribadi. Rasuah menyebabkan orang kaya bertambah kaya dan golongan miskin semakin miskin.
- Pembelian undi harus dihentikan!
- Akta Kesalahan Pilihanraya 1954 mesti dikuatkuasakan.

8. Hentikan politik kotor
- BERSIH 2.0 menuntut SEMUA parti politik untuk menghentikan politik kotor.

Dari Perlis ke Sabah: Warisan Umno – penuh kekecewaan dan kegagalan

Pada bulan Mei 2010, Menteri di Jabatan Perdana Menteri Datuk Seri Idris Jala telah mengejutkan negara dengan mengumumkan bahawa Malaysia akan muflis menjelang 2019 jika kerajaan tidak mengurangkan subsidi dan mengekang pinjaman. Menjelang akhir 2011, hutang Negara kita adalah pada RM460bilion dan masih meningkat.

Kemudian kami telah dikejutkan dengan penemuan oleh pemikir ekomik MIER pada Januari 2012 bahawa jika tiada apa yang dilakukan untuk membalikkan trend semasa dalam perbelanjaan kerajaan dan pendapatan, ekstrapolasi mencadangkan bahawa hutang negara Malaysia akan meletus kepada 100peratus daripada KDNK menjelang 2019.

Tetapi UMNO-BN masih tidak peduli tentang perkara itu, malah diabaikan sama sekali. Sepanjang itu kita terkejut dan masih berasa jijik mengenai kejatuhan RM250juta NFC, yang didedahkan Ketua Pembangkang parti PKR, Datuk Seri Anwar Ibrahim.

Kita semua juga biasa dengan skandal tidak terkira banyaknya yang dibuat oleh UMNO-BN dalam tempoh 56 tahun lalu di peringkat kebangsaan, tetapi tidak banyak yang telah ditonjolkan pada peringkat negeri, seolah-olah semuanya baik di sana.

Sesungguhnya, ia adalah jauh dari baik dan salah tadbir oleh kerajaan UMNO-BN yang tidak bertanggungjawab telah sebenarnya meninggalkan kesan yang kekal dan negatif di setiap negeri di Malaysia. Malah, UMNO-BN telah membebankan rakyat di setiap negeri dengan beberapa masalah.

Kejayaan, genangan atau kegagalan yang mengecewakan?

Seperti satu ayat dari lagu patriotik berbunyi, “Dari Perlis hinggalah ke Sabah,kita sudah Berjaya …”, marilah kita berjalan melalui satu demi satu negeri dan lihat bagaimana sebenarnya prestasi masing-masing. Bolehkah mereka mendakwa mereka ‘Berjaya’?

Perlis adalah sebuah negeri kecil tanpa sebarang sumber asli. Selain menangkap ikan, sukar untuk mendapatkan pekerjaan dan pembangunan tidak lancar. Perlis tidak membangun dan tidak mempunyai wang sendiri yang cukup, rakyat Perlis merupakan tebusan untuk terus mengundi UMNO supaya ia bertahan. Pada satu masa, majlis perbandaran Kangar tidak mempunyai wang untuk membayar sewa pejabat mereka dan mahkamah mengarahkan bangunan itu untuk ditutup. Kerja-kerja diladang tebu dan tembakau semuanya telah diisi dan tenaga tambahan hanya diperlukan secara berkala. Ramai rakyat Perlis merupakan penganggur dan usaha-usaha oleh UMNO untuk menyediakan pekerjaan berakhir hanya dengan memperkayakan kroninya.

Kelantan, sejak dinafikan royalti minyak daripada Petronas oleh UMNO, harus bertahan dengan kebijaksanaan sendiri. Dua puluh enam tahun selepas dijanjikan lebuhraya Kota Bharu-Kuala Krai oleh kerajaan Persekutuan, Kelantan pimpinan PAS telah memutuskan untuk meneruskan dan membinanya sendiri. Pada tahun 1980-an Kelantan pada mulanya dinafikan baja untuk petani padi, dan kemudian royalti minyak. Walaupun dana yang diberikan kepada Kelantan untuk menyelesaikan masalah air bukan geran persekutuan, tidak seperti di semua negeri UMNO-BN, tetapi ialah pinjaman dan perlu dibayar balik. Walaupun UMNO mengisytiharkan dirinya berjuang untuk bangsa, agama dan negara, Kelantan yang merupakan tanah air Melayu telah dinafikan semua bantuan dan manfaat oleh UMNO.

Terengganu juga mengalami masalah yang sama dengan UMNO berkenaan royalti minyak apabila ia telah diperintah oleh PAS tetapi walaupun selepas menerima royalti yang kini, tidak banyak pembangunan sama ada disebabkan oleh perbelanjaan yang tidak masuk akal ke atas projek-projek mega seperti stadium sukan RM292juta di mana bumbung telah runtuh dan terpaksa dirobohkan semuanya. Persengketaan antara bekas menteri besar Idris Jusoh dan pemimpin semasa Ahmad Said juga tidak membantu. Terengganu tidak mendapat manfaat banyak dari Piala Monsun, salah satu projek Idris. Kos menganjurkan acara kapal layar antarabangsa adalah RM300juta pada mulanya dan telah melonjak. Ia kelihatan seperti royalti minyak yang diterima oleh Terengganu telah digunakan untuk memperkayakan pemimpin UMNO.

Kedah, yang dipimpin PAS, adalah sebuah negara pertanian, terutamanya mengusahakan padi. Kedah tidak mempunyai kekayaan sumber semula jadi selain daripada tanah.Tetapi selepas usaha gagal UMNO untuk membangunkannya, Kedah bukan lagi “Jelapang Padi” Malaysia dan penanam bergantung pada Bernas, sebuah firma yang memonopoli perdagangan beras dan dikawal oleh kroni terkemuka UMNO.

Tanah padi Kedah telah ditukar kepada tanah kediaman, perdagangan dan perindustrian dan di sepanjang jalan, kroni UMNO memperkayakan diri mereka daripada pemindahan hak milik tanah dan projek pembinaan manakala pekerja kilang dibayar gaji rendah. Tuan-tuan tanah yang sebelumnya telah menghabiskan wang mereka dan mereka juga perlu mencari sumber pendapatan lain; ramai telah beralih kepada nelayan dan perlu bersaing dengan orang Thai. Budaya asal negeri Kedah telah berubah.

Program-program pembangunan yang diusahakan oleh UMNO mengubah penyumbang utama kepada KDNK daripada pertanian kepada pembuatan. Ini dengan sendirinya bukannya masalah tetapi pembuatan kini telah menjadi sangat kompetitif dan pelabur akan pergi ke tempat lain untuk menjimatkan kos dan mengekalkan keuntungan. Jika anda melawat POLIMAS di Jitra, kilang-kilang biru yang terbengkalai adalah satu bukti kepada ini.

Walaupun ketika pemerintahan Mahathir Mohamad, dengan kilang-kilang dan industri berat seperti Perwaja Steel dan kilang pemasangan kereta, pekerjaan adalah terhad. Kerajaan PAS sekarang telah mewarisi Kedah yang diurus dengan teruk daripada UMNO-BN dan telah berjaya untuk menguruskannya dengan baik untuk mendapatkan No. 5 daripada 13 buah negeri dalam mengejar bagi pelaburan langsung asing. Selangor dan Pulau Pinang – dua lagi negeri Pakatan Rakyat – mengungguli senarai itu.

Penang, yang dipimpin DAP, telah dinafikan pembiayaan persekutuan dan dibiarkan untuk membangunkan infrastruktur sendiri. Seperti Kelantan, Pulau Pinang harus mencari jalan untuk membina semula ekonomi, manakala nasib jambatan kedua Pulau Pinang telah ditinggalkan bergantung pada UMNO. Malah keputusan untuk memperuntukkan RM50juta ke Pulau Pinang untuk tujuan pemuliharaan telah bertukar, dengan menteri kerajaan persekutuan Rais Yatim berkata bahawa wang yang dijanjikan adalah ‘salah faham’. Industri pelancongan di Pulau Pinang juga telah dipinggirkan oleh Kementerian Pelancongan persekutuan.

Perak telah mengalami pencemaran nadir bumi dan salah satu mangsanya meninggal dunia baru-baru ini – satu peringatan yang suram bagi kita semua. Malah getah yang dahulunya sejahtera dan industri perlombongan timah di Perak, yang sepatutnya mendapat manfaat daripada ledakan dalam harga komoditi global baru-baru ini gagal untuk melihat kebangkitan semula langsung. Sekarang, perlombongan bijih timah adalah hanya sebahagian kecil ekonomi negeri Perak. Getah juga telah digantikan dengan kelapa sawit, tetapi tanaman ini menghadapi persaingan sengit dari beberapa minyak masak lain yang dihasilkan di peringkat antarabangsa. Hutan di Perak, dahulunya sumber kayu yang terhad, seolah-olah telah hilang.

Pahang kini dibebani oleh kilang penapisan bumi Lynas. Kerajaan Najib nampaknya tidak peduli tentang potensi risiko radioaktif kepada rakyat di negeri asalnya sendiri. Wang telah bertukar tangan. Timbul percakapan bahawa deposit misteri RM50juta dibayar olehLynas tetapi tidak ada seorang pun seolah-olah tahu siapa yang atau agensi mana yang menerima wang tersebut. Hutan di Pahang juga telah hampir lenyap dan ia tidak berupaya lagi untuk membangunkan ekonomi walaupun royalti besar yang diperolehi daripada aktiviti penuaian kayu masa lalu.

Walaupun terdapat kasino di Genting Highlands dan sayur-sayuran di Cameron Highlands, ia adalah amat membingungkan kenapa Pahang masih mempunyai wang yang tidak cukup dan Lynas perlu masuk campur. Adakah ia disebabkan keadaan terdesak dan ketamakan yang menyebabkan Lynas telah dijemput ke Pahang kerana sumber pendapatan lain negeri ini telah lama telah disedut keluar dan habis digunakan.

Malacca dibebani dengan pelbagai projek besar yang gagal yang telah ditutup oleh Ketua Menteri Ali Rustam. Pelaburan yang besar dalam beberapa projek yang terperangkap dengan kerosakan, dan kerajaan tidak berjaya mendapatkan pulangan yang baik seperti yang diharapkan; iaitu ferris wheel – Eye On Malacca yang harus disingkirkan, monorel yang kerap rosak yang telah menyebabkan ramai pelancong terkandas, litar Go-kart yang rakyat tidak berminat dengannya, planetarium Melaka yang terlalu mahal gagal untuk menarik ramai pengunjung kecuali semasa cuti, lanjutan landasan Lapangan Terbang Batu Berendam yang membazir, dan Bandar Arab yang tidak lengkap dan gagal untuk menarik pengunjung .

Idea gagal Ali Rustam adalah begitu teruk projek-projeknya terpaksa ditutup, ini adalah mengapa ramai orang tidak sedar bahawa semua ini sebenarnya bermaksud untuk membawa Melaka ke hadapan ekonomi negara. Tetapi wang telah dibelanjakan, dengan tiada atau sedikitpun untuk ditunjukkan? Mungkinkah disebabkan rasuah juga?

Negeri Sembilan tidak mendapat manfaat daripada RM250juta Pusat Fidlot Negara, walaupun negeri itu telah memberikan tanah kepada projek penternakan lembu. Kerajaan Negeri Sembilan tidak mampu untuk membesarkan jalan dari Kuala Pilah ke Seremban yang sentiasa sesak dengan lalu lintas. Bandar tentera Port Dickson yang dijanjikan oleh ADUN Bagan Pinang, iaitu bekas Menteri Besar Isa Samad, telah gagal. Kerajaan negeri tidak mampu untuk memegang Pesta tahunan Port Dickson kerana kekurangan dana, apa lagi ‘bandar tentera’ Isa.

Industri pelancongan dan infrastruktur yang diperlukan untuk menerajuinya telah berhenti walaupun Jabatan Pelancongan Negeri Sembilan menganjurkan kempen promosi yang mahal di Putrajaya tahun lepas yang telah dikritik sebagai melampaui batas dan membazir. Skim FELDA di Jelai, Palong dan Bukit Jazeera tidak banyak berubah dan banyak peneroka generasi kedua bergerak keluar. Kawasan perindustrian di Senawang dan Nilai perlahan dan pembangunan yang amat dipuji di Nilai kerana berdekatan dengan Lapangan Terbang Antarabangsa KualaLumpur, LCCT dan Litar Formula One telah menyebabkan banyak rumah yang tidakterjual dan dibiarkan kosong.

Selangor, yang dipimpin PKR, sedang disabotaj oleh Syabas, pemegang konsesi bekalan air yang dimiliki oleh ahli kanan UMNO Rozali Ismail. Syabas tidak mampu untuk menyelesaikan kehilangan air akibat kebocoran. Nampaknya motif tersembunyi ialah untuk memaksa Selangor membeli air dari Pahang sebagai projek pemindahan air, yang boleh dilaksanakan, bertukar menjadi skim membuat wang untuk UMNO dan kroninya. UMNO juga berharap bahawa masalah kekurangan air akan menyebabkan rakyat Selangor marah dengan kerajaan Pakatan Rakyat sekarang. UMNO juga mengurangkan tabung negeri semasa pentadbiran bekas menteri besar terhina Khir Toyo, dan penyedutan wang oleh kerajaannya masih berterusan.

Johore berada di bawah kepungan warga asing di Wilayah Iskandar dan itu akan membuat segala-galanya mahal kepada penduduk tempatan. Disebabkan Iskandar adalah kawasan yang besar, rakyat luar bandar juga akan terjejas oleh kenaikan kos sara hidup kerana sebarang sumber pendapatan yang dipunyai penduduk luar bandar sekarang tidak akan mampu untuk berhadapan dengan peningkatan harga. Rakyat di Johor telah terpedaya dengan pelbagai projek mega seolah-olah ia kepunyaan mereka. Hakikat sebenar ialah ini digalakkan oleh kerajaan persekutuan untuk memberi manfaat kepada pelabur asing dan sudah tentu kroni-kroni mereka yang merupakan mereka yang akan mendapat kontrak untuk membangunkan dan membina Iskandar, bukan Johor. Apa yang penduduk tempatan akan ialah saki-baki sebenarnya.

Sarawak menjadi tebusan bagi Taib Mahmud dan UMNO-BN tidak melakukan apa-apa tentang itu. Taib Mahmud telah menjadikan Sarawak harta peribadinya sendiri dan orang asli dan penduduk tempatan lain dianggap tidak berotak dan tiada kebolehan untuk berjaya atau tidak layak mendapat mana-mana bantuan dan peluang dari kerajaan negeri. Taib telah sombong menegaskan bahawa Sarawak adalah hanya untuk orang-orang yang mempunyai otak, tidak perlu dikatakan bahawa orang-orang yang layak mestilah dari kalangan keluarga, saudara-mara dan kroninya!

Sabah adalah negeri yang termiskin di Malaysia. Bank Dunia di Washington telah mengesahkan melalui kajian baru bahawa Sabah bukan sahaja negeri yang termiskin di Malaysia tetapi ia adalah mungkin kekal sebegitu untuk tempoh masa yang agak lama kerana usaha-usaha semasa yang lemah dalam membasmi kemiskinan. Pekerjaan adalah sukar didapati di Sabah dan ia dibanjiri oleh sekurang-kurangnya 200,000 pendatang tanpa izin. Ramai pakar menganggarkan angka itu untuk meningkat sekurang-kurangnya dua kali ganda dan dengan itu pendatang tanpa izin akan menentang rakyat negeri untuk sebarang rezeki yang jatuh dari meja UMNO-BN.

Bagaimana pula dengan yang berjaya?

Sudah tentu ada kejayaan, tetapi ini adalah sokongan minimum yang UMNO-BN telah berikan kepada setiap negeri untuk menenangkan rakyat. Jalan raya, sekolah, hospital, perumahan, bekalan air paip dan bekalan elektrik adalah keperluan. Kemudahan ini juga adalah kewajipan yang patut disediakan oleh UMNO-BN tetapi gabungan itu tidak melihatnya begitu. Kepada pemimpin UMNO-BN, ini adalah semata-mata kemurahan hati dan kecekapan mereka dan negeri-negeri harus bersyukur kepada mereka bagi keperluan asas dan terus mengundi mereka kembali berkuasa.

Walau bagaimanapun, ia kelihatan seperti musim berusia 56 tahun UMNO-BN di Malaysia akhirnya berakhir. Rakyat kini sedar bahawa apa sahaja pencapaian di setiap negeri tidak tahan lama. Mereka juga tertanya-tanya apa yang telah berlaku kepada semua wang yang kononnya ‘dilabur’ bagi pihak mereka oleh UMNO-BN supaya anak-anak mereka dan generasi akan datang akan sentiasa mempunyai sesuatu untuk bergantung. Ia kelihatan seperti tiada apa pun dan setiap orang dari Perlis ke Sabah -kecuali negeri-negeri Pakatan Rakyat – akan perlu bermula dari awal sekali lagi.

Malaysians ‘owe’ Sabah the truth

The Malaysia Agreement 1963 signed between Federated Malaya, North Borneo (now Sabah), Sarawak and Singapore, was not a deed of subservience but rather an invitation to share equally a political table.

Come July 9, it would be 49 years since Britain, the Federation of Malaya, North Borneo (now known as Sabah), Sarawak and Singapore entered into an agreement that gave rise to the formation of the Federation of Malaysia in 1963. But how many of us knew that?

The fact is we remember, easily enough, Aug 31, 1957 as Merdeka day and of late Sept 16, 1963 as Malaysia Day but what about July 9, 1963 – the day the Malaysia Agreement was signed by a then independent Sabah and Sarawak?

The agreement was not a deed of subservience but rather an invitation to share a political table and march ahead into a bright future.

But that did not happen. History has distorted the facts and killed off its proverbial leaders. A generation of children have been born into thinking that Malaysia is one and not 1+2 (Singapore withdrew from the Federation of Malaysia in 1965 leaving only Sabah and Sarawak).

FMT took to the streets in downtown Kuala Lumpur recently to ask if Malaysians have heard of the 1963 Malaysia Agreement that lured the Borneo states into the federal loop.

Of the 50 people we spoke to only three had heard of it but they couldn’t elaborate on what they knew of the agreement.

The shoulder-shrugging, furrowed foreheads and sheepish smiles were testimony to the fact that this might just be something not important enough to remember, to teach or to acknowledge.

As shallow as this sounds, perhaps what makes it harder to remember this day is that it’s not a public holiday. One has to tell it like it is sometimes. We call a spade a spade.

The Malaysia Agreement 1963 – in a more contemporary nutshell – would be living in an apartment building, or a guarded/gated housing area.

Being in this collective protective enclave doesn’t in any way mean that a person has to give up their individuality or privacy.

Sabah, Sarawak not ‘states’

It just means that no matter how different these homes and apartments are, they will all be given the same kind of protection by the company mandated to do just that.

That is no different with Sabah and Sarawak’s agreement with then Malaya and Singapore.

North Borneo (now Sabah) and Sarawak agreed to enter into the Malaysia Agreement 1963 with the Federation of Malaya based on the terms of a 20-point and 18-point agreement respectively.

For the record, the formation of the Federation of Malaysia was not conceived with the idea that Singapore, Sabah and Sarawak would be “included” and recognised as the 12th, 13th and 14th states of the new federation, thus adding to the 11 states in the federation of Malaya.

What was agreed upon was that the Federation of Malaya, Singapore, North Borneo (Sabah) and Sarawak would come together to form the federation of Malaysia as equal nation-state partners within that new federation.

This was agreed upon on the grounds that there would not be any loss or decrease in their respective status as independent sovereign nations.

Look closely at Clause 18 of the 20-point agreement in relation to Sabah and you will find that it hypothesises that the head of the state of Sabah was to be called “Yang di-Pertua Negara” and not “Negeri”.

Clause 3 of the 20-point agreement, which relates to Sabah, states: “Whilst accepting that the present Constitution of the Federation of Malaya should form the basis of the Constitution of Malaysia, the Constitution of Malaysia should be a completely new document drafted and agreed in the light of a free association of states and should not be a series of amendments to a Constitution drafted and agreed by different states in totally different circumstances.”

The real kingmakers

An avid Kuala Lumpur-born Sabah observer who gives his name as Sharif, opined that Peninsular Malaysians and Putrajaya “owe” Sabahans and Sarawakians the truth.

“I think Peninsula Malaysians and the government owe it to the people of Sabah and Sarawak to get to the truth of what was agreed in 1963.

“It is imperative that we demand that all that was agreed on be carried out no matter if a new or old government takes over post-general election,” Sharif said.

He also stressed the importance of perusing the contents of the Malaysia Agreement as tedious as it may be – to take a good hard look at the 20- and 18-point agreements and re-learn what it’s truly about with particular attention to the status and position of Sabah and Sarawak.

DAP national adviser and parliamentarian Lim Kit Siang, during his visit to Kota Belud, Tuaran, and Kota Kinabalu in February 2010, declared that the natives of Sabah were ‘kingmakers”.

The term “kingmaker” drew rousing applause and supporters billed Lim’s visit as a “powerful political whirlwind of change” stirring in the whole of Sabah, state party publicist Dr Edwin Bosi said in a press statement.

To this, Sharif added: “Native leaders of Sabah in the past and now are being touted as the real ‘kingmakers’ in Sabah and Malaysian politics.

“Some believe that the banned book ‘The Golden Son of the Kadazan’ gives a good account of the struggle of the local natives, especially the Kadazan community. The book which describes the struggle of the Sabah native Peter Majuntin was banned, while the book by [former premier] Dr Mahathir Mohamad ‘Malay Dilemma’ has been lifted.

“Where is the fairness in that?”

He also spoke of the betrayal the BN government has inflicted on the Sabah native community.

“This became obvious after the reverse takeover of power in Sabah in 1994. Anyone who is familiar with what happened will recall that the rotation system of the Sabah chief minister had only allowed Bernard Dompok to serve as CM for nine short months.

“After winning the following election, Umno-led BN government decided to drop the rotation system, and that is the end for a Kadazandusun and Murut chief minister,” he added.

Sharif is also of the opinion that the state’s political history must be a reminder to Kadazan natives of their role in the rise of Berjaya and Parti Bersatu Sabah (PBS) governments.

He said the Kadazan natives had been marginalised and emasculated.

“The future is in the hand of the Sabah natives. They have fantastic power that they can release and become equal citizens, ” Sharif said.

Another Sabah observer encapsulates the situation lucidly when she proferred, “Before any nation building can happen, Sabah needs to first consolidate its identity.

“The 13th general election is perhaps the most significant election for Sabah because for the first time, Sabahans feel like someone is there to champion their cause.

“Barisan Nasional will win, but the question of what would that victory mean remains.

“If the opposition were to secure a 10-seat [majority] win, this will be very significant. Because then, there might be the possibility that Sabah will be looked at as a nation.”

Time for a ‘Dayak Movement for Change’

KUCHING: Dayaks, who are voluminous in numbers in Sarawak, must form an organisation that can act as a platform to collectively demand for their legimite rights form the government.

Citing the successes of Hindraf, Perkasa and the Chinese community’s ’325′ campaign, blogger Dr John Brian Anthony said the time was right for a Dayak Movement for Change (DayMove) to be formed.

“We need to form a Dayak Movement for Change to demand for our needs otherwise we may never get the government’s attention to our needs.

“I think the political parties have their role but DayMove is outside of the current political platform,” Brian said.

The Dayaks comprise the Ibans (713,421), Bidayuhs (198,473) and Orang Ulu groups (156,436).Together they form one half of Sarawak’s population.

“In the old days when you talk about Dayak – someone will label you as racist or that you are not sensitive to other races.

“Today, that does not hold true anymore. Why?

“Hindraf spoke and acted on their demands. The Indian swing their vote in favour of Pakatan Rakyat. Perkasa came out screaming their lungs out to try silence the non–Malay. Umno and Mahathir came out to support them.

“The Chinese use various platforms e.g. “325″ as an example to demand for action to get Chinese speaking teachers only to teach in Chinese schools.

“Civil societies demand for clean election through Bersih and have acted on it. Even the Orang Asli managed to form their platform to demand from the government what they need from the government.

“What are the Dayaks doing to press for their demands from the government?” Brian asked, pointing out that it is time the Dayaks form one.

Broad-based support needed

He said DayMove could imbibe some of the approaches used by these organisations to demand for Dayak needs.

“To my mind such organisation must be formed immediately especially before the coming 13th general election.

“The organisation can articulate the needs of Dayaks as we lack in many critical fields like in economic and business, education, quality of life, health care, infra-structure etc.

“We will need a broad-based support from across the community from helping to organise the daily administration to organise events and also the strategic team to work out the future objectives.

“We can always learn and have networking with other similar groups in order to draw input and guidance from their experience,” he said.

He urged the people to lend their support to the idea adding that such an organisation would need all kinds of resources including a team of very focused people with the ability to work with other organisations that are sympathetic to the objectives of DayMove.

“This would be a new challenge for Dayaks to put forward their brave heart to fight for the cause of the Dayak community.

‘It is also a lot of risk taking and adventure that we will never really know the consequences of our action upon ourselves.

“But then many lives have been sacrificed all over the world even to this very day to fight for their respective community’s rights and the sanctity of the beliefs and honour of their country.

“If other community can do it why not us?’ said Brian who is also the chairman of the DAP think-thank, Dayak Consultative Committee.

Disabled man asks Sarawak government if aid cut over opposition support

KUCHING, March 5 — Disabled farmer Frusis Lebi today demanded the government explain its order to discontinue his welfare and agricultural aid over his support for the opposition during last year’s Sarawak state polls.

The 51-year-old, who suffers from hand and feet deformities, had last week alleged that the government had cut off all his financial assistance for months now due to his political affiliation.

But the father of two lamented today that his show of opposition support had only been to fly a PKR flag outside his home in Sri Aman near here during the April polls.

“I have my reasons for supporting the opposition but that is not the point… I believe I reserve the right to support whichever party I want,” he said when contacted this afternoon shortly after attending a press conference at the DAP headquarters here.

According to Frusis, his monthly RM300 welfare aid had been stopped since last October while his subsidies for fertilisers and fruit seeding were discontinued from December.

He alleged that officials from the Welfare Departmenthad explained last year that his disabled persons’ aid was halted as his monthly income has already exceeded the aid qualification limit.On his farming subsidies, Frusis revealed a letter showing instructions allegedly made by Sarawak Assistant Minister Datuk Mong Dagan ordering the Sri Aman Agriculture Department to stop further disbursement of funds due to him.

In the letter dated December 8 sighted by The Malaysian Insider today, Mong had told the department to stop “with immediate effect” all forms of government assistance to Frusis, “an underprivileged person (OKU) from Entulang Entawa, Sri Aman”.

“This is because he is against government policies and openly supported the opposition candidate during the 2011 state election. Other than that, he had also prepared an operation room for the opposition candidate,” Mong had allegedly written in the letter.

Frusis told The Malaysian Insider that he obtained the letter last Thursday from a department official after pestering the latter repeatedly for a reason why his aid was discontinued.

He denied helping the opposition campaign during the polls, saying all he had done was “sit quietly in my house”.

“My family and I feel stressed. I have a 35-year-old son who is also an OKU… a deaf mute,” he added.

Sri Aman DAP branch chairman Leon Jimat Donald told The Malaysian Insider that should Mong fail to offer any explanation on the issue by Wednesday, a report will be lodged with the Malaysian Anti-Corruption Commission (MACC).

“We also urge the police to investigate so we can determine the validity of the letter,” he said.

“But the victimisation of rural folks in Sarawak has been going on for a long time now. They live in terror here… in fear of being bullied,” he added.

Leon said that in Frusis’ case, the latter had been brave enough to show his support for the opposition by flying the PKR flag outside his room in the longhouse where he stays with his wife and two sons.

“At the time, the village headman burned the flag but I think he replaced it with another. The point here is that this goes against his constitutional right to freedom of association,” he said.

Bandar Kuching MP Chong Chieng Jen told The Malaysian Insider that he will refer the matter to Suhakam.

During the April 16 polls in Barisan Nasional’s (BN) fortress of Sarawak last year, the federal opposition pact of Pakatan Rakyat (PR) made historic gains when the DAP doubled its seat representation in the state assembly from six to 12 while PKR won three seats.

Let’s not give into the racial politics of the ruling government and be more sensitive in reporting.

This is an indirect way of telling the public to support BN, otherwise you people will also suffer the same fate as that poor guy who happens to be an OKU. Bantuan Rakyat 1Malaysia(BR1M): MALAYA vs SARAWAK

CERITA DI MALAYA

Seorang pemimpin bahagian MCA di Pahang yang berpangkat Datuk turut  menerima Bantuan Rakyat 1Malaysia (BR1M) sebanyak RM500 dan ini telah menimbulkan tandatanya di kalangan penduduk tempatan dan warga internet.

NONEPengerusi MCA bahagian Bera, Datuk Tang Hock Lok (kanan),
yang juga seorang pemimpin masyarakat dan dermawan terkenal di Triang, telah menyumbangkan wang RM500 itu kepada seorang penduduk kampung yang kurang upaya.

Berita mengenai Tang menerima BR1M telah mencetuskan bantahan di beberapa forum internet serta media sosial.

Ramai mempersoalkan kelayakannya untuk menerima bantuan tersebut, dan sama ada program BR1M telah disalahgunakan.

Menurut laporan di akhbar harian Cina hari ini, Tang menolak sebarang dakwaan penipuan.

“Saya memohon melalui prosedur yang betul dan pihak berkuasa telah meluluskan permohonan saya kerana saya layak,” Tang dipetik sebagai berkata.

Tang juga dipetik berkata bahawa tidak ada unsur-unsur yang menyalahi undang-undang atau penyalahgunaan kuasa dalam proses tersebut.

Beliau menemui pemberita selepas memberi wang RM500 itu kepada seorang penduduk kurang upaya di kampung baru Triang. Tang adalah ketua kampung di situ.

“Niat awal saya memohon bantuan itu adalah untuk menyumbangkan wang RM500 itu kepada mereka yang memerlukannya,” kata Tang.

She has been living on her savings since she worked for 25 years. My whole family, friends and relatives will give out vote to PR. 1Best If Tang has a sundry shop, his income will surely exceed RM3000 per month. Any sundry shop with less than RM3000 per month cannot stay open in their business. It is not sufficient to pay a worker plus all overheads to be incurred, simple calculation will tell you that such business is not viable. Can he still be qualified? Very doubtful.It is a shameful scheme when such awarding of RM500 is not properly vetted.

Why don’t he tell us why that is the case (obviously its not being rich) and second, do something about it? Fuming does nothing and pointing the finger at BN does nothing. This is our Sarawakian style. As long as we can blame someone else, we don’t need to do anything. PM Najib did a good thing to give RM500 as opposed of not giving anything. Its the state leader’s job to make sure it gets there. This should be a bi-partisan effort. The failure is BR1M in Sarawak is due to the failure of LOCAL LEADERS.
      I would like to see the MP be more aggressive. MP DK should go on a hunger strike or just lead a protest crowd and let himself be heard. I would like to see him fight and fight loud!!

It doesn’t make sense for a person who works in kuching & has to travel all the way to lawas just to collect rm500..? If less than 50 persons only qualified from the lun bawang for BR1m, than those ‘ORG KAMPUNG’ must be earning above rm3000.00/month..
